On March 19, 2022, at approximately 12:42 p.m., a Missoula Police Department Officer was dispatched to an area in the 6800 block of Alisha Drive. A caller reported that a male was "slumped over" in a parked vehicle. Police Public Information Officer Lydia Arnold explains.

“The male was identified as David Fisher,” Arnold said. “The caller reported not recognizing the vehicle and told officers other observations they had made that were consistent with drug use or potential drug deals. On scene, officers were able to wake Fisher up and while speaking, noticed indicators of impairment. Officers were concerned about Fisher being in control of the vehicle while impaired and conducted the standardized field sobriety tests.”

During the Standardized Field Sobriety Tests, the officer Fisher displayed several indicators of impairment. The officer ran Fisher through dispatch and was informed that he was on probation out of Ravalli County.

“During the investigation, officers learned Fisher was on probation for a drug offense,” Arnold said. “Probation and parole became involved and requested a probation search of the vehicle. During the search, officer located a substance that tested presumptive positive for methamphetamine. Fisher was arrested and taken to the Missoula County Detention Center on felony charges for DUI and possession of dangerous drugs.”

According to Fisher’s Probation Officer, Fisher was on probation for drug offenses and tested positive for methamphetamine approximately 10 days prior to this interaction. Court documents indicate Fisher has four prior DUI convictions.

After Fisher was transported to jail, another officer told the original officer that she found a white colored pill on the lip of the backseat in the original officer’s patrol car, right behind Fisher’s legs.

Fisher began arguing with the officer, claiming that the pill was in the patrol vehicle prior to him getting in and the pill was not his. The original officer noted that she conducted a standard pre-shift vehicle check at the beginning of her shift, specifically checking the back seat as part of procedure. The officer confirmed that there was not a pill located in her vehicle at that time.

During the intake process at the jail, Detention Officers located a second pill matching the same suspected methamphetamine that was already taken into evidence. The second pill was taken into evidence as part of the ongoing investigation.
