Missoula, MT (KGVO-AM News) - On May 14, 2023, a Missoula Police Department Officer was dispatched to a storage facility on Industry Road. The manager of the storage facility reported she kicked out a female, later identified as 45-year-old Rachel Depuy, the night prior and Depuy found her way back in. The manager wished for Depuy to be trespassed.

The officer located Depuy next door at another storage facility and he recognized her from prior contacts. The officer had to yell at Depuy because she refused to come and speak with him. The officer yelled to Depuy that she was trespassed from the storage facility and Depuy verbally acknowledged the officer. 

Later that day, Depuy returned to the storage facility and the manager contacted 911 again. Officers arrived on scene and located Depuy who began running from officers. Officers were able to catch up to Depuy and began to place her under arrest.

According to court documents, Depuy was actively resisting by flailing around both her arms and legs near officers. Officers were eventually able to arrest Depuy and placed her in a patrol vehicle. Other officers also arrived on scene.  

Depuy began flailing around in the patrol vehicle and started kicking the windows. It was determined that the WRAP restraint would be utilized. An officer assisted in placing the WRAP restraint on Depuy. While assisting, Depuy lunged forward towards the officer and bit his wrist causing him pain and visible bite marks. After being placed in the WRAP restraint, Depuy was transported to the Missoula County Detention Facility. 

Depuy is currently being charged with felony assault on a peace officer and criminal trespass to property. This case is being filed direct to District Court. 

Court documents indicate Depuy currently has another matter pending in Montana’s Fourth Judicial District Court, which is set for a Trial Scheduling Conference on Thursday, May 18, 2023. The State recently filed a petition to revoke release in that matter with a request for a warrant in the amount of $40,000. The State also requested a warrant issue in this matter for $40,000 to run concurrently.
